EU withdrawal policy

The aim of our Right of Withdrawal Policy is to explain the right of withdrawal provided for in the EU on consumer rights (2011/83/EU).  This information is provided on behalf of any of the sellers who use our platform to sell to buyers living in the EU, European Economic Area (EEA).
Buyers are given the right to cancel and return any purchases made, provided that the buyer does not purchase lots professionally and the buyer lives in a country within the EEA.
The right of withdrawal gives Buyers ('Consumers') a 14-day 'cooling-off' period to decide whether they wish to keep their purchase. Within the cooling-off period, the Consumer may cancel their purchase without giving any reason for cancellation. The conditions for the Consumer are as follows:

The cooling-off period is 14 days
The cooling-off period starts on the day after you receive the Lot or:
If the Lot is delivered in more than one shipment or consists of several parts, the cooling-off period starts on the day of the last shipment or the day the last part is delivered. For agreements on the normal delivery of lots during a set period, it will start on the day the first lot is received. It is also possible to waive the purchase before receiving the lot.

Obligations during the cooling-off period
During the cooling-off period you have to treat the batch and its packaging carefully. You are allowed to evaluate the lot in a similar way as you would in a physical store.
It is very important to treat the lot carefully, as you can be held responsible for any loss of value beyond that which could result from careful treatment. This refers only to treating the batch in an acceptable manner according to the nature, characteristics and performance of the batch. If your treatment of the batch has diminished the value of the batch, an amicable solution will have to be reached.

Withdrawal notice time
To exercise your right of withdrawal, you must notify us within 14 days of receipt of the goods. You can send us a notice, with the details of the lot to our email: clientes@sorollasubastas.com

Confirmation of withdrawal request
As soon as you have informed us that you wish to cancel your purchase, we will evaluate your request. Once we have approved your request, you will need to send us the goods as soon as possible.
If cancellation is not possible in accordance with the right of withdrawal, we will explain to you why the right of withdrawal does not apply for that particular purchase.

Return of the Lot
The lot, including all related accessories that were delivered with it, has to be returned within 14 days after our approval of your request. Where possible, you should return the lot in its original condition and packaging to :

If the lot is not returned within 14 days of our approval of the withdrawal, you will lose the right of withdrawal.
If the lot is returned within 14 days and there are no problems with the shipment or damage, you will be refunded the purchase price and shipping costs.

Return shipping costs
If you cancel and return a lot under the right of withdrawal, you will have to cover the costs, risks and charges of the return shipment. We recommend that you pack the lot correctly and securely and use insured shipping. This is because, if it is proven that the lot has been damaged or lost during the return shipment, you will have to contact the transport company to claim damages.

Excluded items 
The following products that can be offered on our platform are excluded from the right of withdrawal. This list contains the products that can be sold on our auction platform and that are excluded.
You cannot withdraw from the purchase of these products:

1.     Products or services whose price is linked to financial market fluctuations. Includes, but is not limited to, certain precious stones and metals, and goods made from these materials. For example, diamonds, diamond jewelry that determines value, gold coins, and bullion.

2.     Products that were manufactured according to requirements, that are not prefabricated, and that were manufactured for a specific person.

3.     Products that spoil quickly or have a limited life span.

4.     Sealed products whose seal is broken and which cannot be returned for health or hygiene reasons.

5.     Sealed audio, video or software recordings whose seals have been broken after delivery

6.     Newspapers, journals or magazines, with the exception of subscriptions to them.
